Terms of Service

Please read these Terms of Service ("Terms") carefully before using Web Analyzer App ("Service", "we", "us", or "our") operated at webanalyzerapp.com. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility and Account Registration

You must be at least 16 years old to use the Service. By registering you represent that you meet this requirement and that the information you provide is accurate and complete. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

You must not create accounts by automated means or under false pretences. One person or legal entity may not maintain more than one free account.

2. Acceptable Use

You agree to use the Service only for lawful purposes and in compliance with these Terms. You must not:

• Install the tracking snippet on websites you do not own or have explicit permission to track.
• Track websites containing illegal content, child sexual abuse material, hate speech, or content that promotes violence.
• Attempt to reverse-engineer, decompile, disassemble, or access the source code of the Service.
• Use the Service to conduct or facilitate phishing, fraud, spam, or other deceptive practices.
• Interfere with the operation of the Service, including by transmitting malware or conducting denial-of-service attacks.
• Circumvent any rate limits, access controls, or usage quotas.
• Resell or sublicense the Service without our express written permission.
• Send personally identifiable information of website visitors in custom event payloads without a lawful basis under applicable privacy law.

3. Free Plan

We offer a Free plan at no charge. The Free plan includes 1 website and up to 50,000 events per calendar month. When you reach the monthly event limit, new events are silently discarded until the next billing cycle begins. We reserve the right to modify Free plan limits with 30 days' notice.

4. Pro Plan and Billing

4.1 Subscription

The Pro plan is available for $14.99 USD per month. Your first month is free (trial period). After the trial ends, you will be billed automatically on a recurring monthly basis unless you cancel before the trial expires.

4.2 Payment

Payments are processed by Stripe. By subscribing to Pro, you authorise Stripe to charge your payment method on a recurring basis. All prices are in US Dollars and exclusive of applicable taxes, which may be added at checkout depending on your location.

4.3 Cancellation

You may cancel your Pro subscription at any time from the Billing Portal in your dashboard. Cancellation takes effect at the end of the current billing period. You will retain Pro features until that date. We do not provide partial-month refunds except as described in Section 4.4.

4.4 Refund Policy

If you are not satisfied with the Service within the first 7 days of your first paid charge (after the free trial), you may request a full refund by emailing billing@webanalyzerapp.com. Refund requests after 7 days are evaluated on a case-by-case basis at our sole discretion.

4.5 Downgrades

If you downgrade from Pro to Free, your data is retained but you will lose access to Pro-only features (cohort analysis, unlimited goals & funnels, 5-minute uptime checks) at the end of your current billing period. If your account exceeds Free plan limits at the time of downgrade, you will not lose data but new events will be dropped until usage falls within limits.

4.6 Price Changes

We reserve the right to change subscription prices. We will provide at least 30 days' notice via email before a price change takes effect for existing subscribers.

5. Intellectual Property

The Service, including all software, design, trademarks, and content, is owned by Web Analyzer App and protected by copyright and other intellectual property laws.

You retain ownership of your data (websites, analytics data, custom event payloads). By using the Service, you grant us a limited licence to store, process, and display your data solely for the purpose of providing the Service to you.

The tracking snippet (tracker.js) is provided for installation on your websites. You may not modify, redistribute, or host the tracker on our behalf without permission.

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You are responsible for ensuring that your use of our tracking snippet on your websites complies with applicable privacy laws (including GDPR, CCPA, and similar regulations) in the jurisdictions where your website visitors are located.

7. Uptime and Service Availability

We aim to provide a reliable service but do not guarantee 100% uptime. Scheduled maintenance windows will be communicated in advance where possible. We are not liable for data loss or interruptions caused by factors outside our reasonable control.

8. Termination

We may suspend or terminate your account immediately, without notice, if we determine that you have violated these Terms or that your use of the Service poses a security or legal risk to us or other users.

You may terminate your account at any time from the Profile settings page. Upon termination, your data will be deleted in accordance with our Privacy Policy.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WEB ANALYZER APP AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $50 USD.

11. Indemnification

You agree to defend, indemnify, and hold harmless Web Analyzer App from any claims, liabilities, damages, and expenses (including legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts specified in your local jurisdiction, or as agreed between the parties.

13. Changes to These Terms

We may revise these Terms from time to time. When we make material changes, we will update the "Last updated" date above and notify you by email at least 14 days before the changes take effect. Your continued use of the Service after that date constitutes acceptance of the updated Terms.
